Politécnica de Ingeniería y Arquitectura, S.L.P.(HEREINAFTER THE OWNER) with address for the purpose of notifications at C/ Balmes 08006 - Barcelona - Barcelona with Tax Identification Number B58913203, telephone: 932389320 and e-mail: admon@politecnica.com, which disseminates on its website, www.politecnica.com, certain contents of an informative nature about its activities. These general conditions regulate solely and exclusively the use of THE OWNER’s website, www.politecnica.com, by the USERS who access the same. These general conditions are shown to the USER on the website, www.politecnica.com, on each and every one of the pages, so that he can read, print and file them and accept them via the Internet, and be fully informed of the same.
Access to THE OWNER’s website implies the acceptance, without reservations, of these general conditions of use, which the USER declares to understand in their totality. The USER undertakes not to use the website and the services offered on the same for unlawful activities and to respect these general conditions at all times.

FIRST.- CONDITIONS OF ACCESS AND USE
1.1.- The use of THE OWNER’s website does not require the inscription of the USER. The conditions of access and use of this website are strictly regulated by current law and by the principle of good faith, the USER undertaking to make good use of the website. All actions which violate the legality, rights or interests of third parties—right to privacy, data protection, intellectual property, etc.—are prohibited. THE OWNER expressly prohibits the following: 
1.1.1.- Carrying out actions which, by any means, on or through the website,  might cause any type of damage to the systems of THE OWNER or to third parties. 
1.1.2.- Carrying out, without due authorization, directly or in a concealed way, any type of advertising or commercial information, mass e-mailing (spamming) or sending large messages in order to block web servers (mail bombing).
1.2.- THE OWNER may interrupt access to its website at any time if it detects any use of the same which is against the law, good faith or these general conditions- see the fifth clause.

SECOND.- CONTENTS

2.1.- THE OWNER, using internal and external sources, such that THE OWNER assumes sole liability for the contents created internally.  
2.2.- The USERS, through collaborations or voluntary introduction of contents, both graphic and written, directly or indirectly, by means of links, the USERS assuming sole liability for said contents, and THE OWNER being expressly exempt from all liability for the same. The USER introducing any contents to THE OWNER’s website declares the absolute legality and authorship of the same and expressly assumes any type of liability which may arise from said contents. The USERS also assume liability for the opinions introduced in the chats and forums provided for them on the website. THE OWNER shall not be held liable, in any case, for the opinions expressed in said forums, and may withdraw or restrict access to those USERS who violate current law, and inform the Courts any actions constituting any type of penal or civil offense. 
2.3.- THE OWNER reserves the right to alter the contents of its website at any time. THE OWNER does not guarantee or take responsibility for the correct functioning of the links to the websites of third parties appearing on its website.

THIRD.- LIABILITY
3.1.- In no case shall THE OWNER be liable for:
3.1.1.- Failures and incidences which may arise in communications, erasing or incomplete transmissions; such that there is no guarantee that the website services will be operative at all times.
3.1.2.- Any type of damage which the USERS or third parties may cause to the website.  
3.1.3.- The reliability and truth of the information introduced to the website by third parties, either directly or through links. Also, Politécnica de Ingeniería y Arquitectura, S.L.P.,shall collaborate with and notify the appropriate authority of these incidences whenever they have reliable knowledge that the damage caused constitutes any type of illicit activity.
3.2.- THE OWNER reserves the right to suspend access without prior notice, at its discretion and in a permanent or temporary way, until such a time as effective liability for the damage which may be caused is assured.  Also, THE OWNER shall collaborate with and notify the appropriate authority of these incidences whenever they have reliable knowledge that the damage caused constitutes any type of illicit activity.

FOURTH.- COPYRIGHT AND TRADEMARK
The Politécnica website, www.politecnica.com – its own contents, the programming and design of the website—have full copyright protection, any reproduction, communication, distribution and transformation of said protected elements being expressly prohibited without the express consent of Politécnica de Ingeniería y Arquitectura, S.L.P.

FIFTH.- JURISDICTION AND APPLICABLE LAW
These general conditions are regulated by Spanish law. For the resolution of any disagreement or dispute arising from these general conditions, jurisdiction shall be held by the Courts of the place of residence of the USER, in the event of the latter holding the condition of consumer. Otherwise, jurisdiction shall be held by the Courts of the place of residence of Politécnica de Ingeniería y Arquitectura, S.L.P., the USER expressly renouncing any other jurisdiction which may correspond to him.

SIXTH.- In the event of any clause of this document being declared null, all other clauses shall remain valid and shall be interpreted bearing in mind the will of the parties and the purpose of the conditions themselves. THE OWNER may decide not to exercise one or other of the rights and powers conferred upon it by this document, without this, in any case, implying the waiver of the same, except in the case of express acknowledgement by THE OWNER.

SEVENTH.- For the exercising of its activity, THE OWNER has the prior administrative authorization of Inland Revenue through payment of the Economic Activities Tax. 

EIGHTH.- For the exercising of its activity, THE OWNER is registered in the professional association, Association of Civil Engineers, with association number 8477 and with the certificate of Civil Engineer, issued in Barcelona and in accordance with applicable regulations.
